As fun as Upgrade UP is, we unfortunately are forced to have some legal jargon. Below are the terms and conditions for upgradeup.com. By using our website and services, you agree to the following agreement:   Quotes Upgrade UP will offer an initial quote when possible. Some items are not valuable for a credit of any kind, in which case the application will be denied. While we try to offer initial quotes for every product, unfortunately it isn't possible. Most items however will be eligible for an initial quote. Initial quotes are given as a range. The final value Upgrade UP determines will be within the initial quote's range, with the following exceptions: 1. The item is not in the condition described (e.g, you selected "working" for a non-working item) 2. Some or all of the accessories you described are not included 3. You do not ship the item within 7 days of accepting the initial quote In the event one or more of these exceptions occur, Upgrade UP will determine a new final value. You will be contacted via email with the new final value, and provided the option to either accept or reject the decision. If you choose to reject the final value, you will be responsible for an assessment fee of $15. Your item will not be sent back to you until the $15 fee is paid. In the event the assessment fee is not paid within 7 days, you forfeit possession of the item, and Upgrade UP will destroy or liquidate your item. If you accept your initial quote, you will immediately be able to generate a FedEx shipping label online. The shipping costs are free for you. The item must be shipped using our FedEx label and within 7 days of accepting the quote in order to receive a final value within the initial quote range. Assuming your item is as described in your application, we will determine a final value within the initial range. A check will be mailed within 7 business days to the address you provided when you originally submitted your application. Upgrade UP takes no responsibility if you change your address. Loss of data and/or unmentioned items Upgrade UP is in no way responsible for the following: 1. Data left on the device; Upgrade UP will try to remove all data from the device prior to selling it. We will not backup your data, nor be held responsible for any data left on the device. We are not responsible for damages caused by Upgrade UP's erasure of data on a device. We are not responsible for damages caused by data that was not able to be erased by Upgrade UP. 2. Items not listed in the "included accessories" section. Should you include accessories not mentioned during the application process, Upgrade UP is not responsible for returning those items, nor will Upgrade UP reimburse you for those items. Condition definition While applying for an initial quote from Upgrade UP, you are asked the condition of the item. "Working" is defined as a fully functional device, with no technical faults whatsoever. Items that exhibit any technical malfunction are defined as "non-working" condition. Any quote given for an item stated in the application as "working" which is deemed by our company as "non-working" is null and void, and a new final value will be given when the item arrives at Upgrade UP's office(s). Risk of passage Upgrade UP is not responsible for damages or loss in transit. You are responsible for any damages or loss in transit that may occur. Upgrade UP is only responsible for an item once it has been received by Upgrade UP (verified by an online signature via the tracking number). Accuracy of information, quotes, etc While Upgrade UP tries its best to accurately quote items, typographical errors and technical errors may occur. In the event of an error, Upgrade UP will correct the error, and offer you the following options: 1. You may proceed with the trade in, using the new final value 2. You may have the item returned to you, free of charge Upgrade UP will not pay Final Values based on erroneous quotes under any circumstances. Additional Terms Upgrade UP may modify these terms and conditions at any time withour prior notice. You will be bound to the new modified terms laid forth in this agreement.
